1. Introduction

Academy Sports + Outdoors strives to provide you a great shopping experience and deliver value on our assortment of products and services. Information you share with Academy Sports + Outdoors allows us to optimize your shopping experience and to ensure that we are delivering value to all our customers throughout our assortment of products and services.
This privacy policy explains how Academy, Ltd., d/b/a Academy Sports + Outdoors (together with its subsidiaries and affiliates, “Academy Sports + Outdoors,” "Academy," "we," "us," or "our") processes personal data when you interact with us online or in-store, such as when you interact with us or our service providers, vendors, or other individual businesses (“Vendors”) via our or their respective websites, mobile applications (“apps”), or Customer Care communication channels, and offline, when you visit us at our stores (such websites, apps, channels, and stores, collectively, our “Sites”).
This Policy is subject to and governed by our Terms and Conditions of Website Use.

2. How We Collect Personal Data

From you online. This includes personal data and other information that you provide to us or our Vendors when you visit and/or use our Sites, purchase items from us through our Sites, sign up for our digital communications, create an online account, contact Customer Care, apply for credit online, complete a survey, apply for a job, or otherwise interact with us or use our Sites. “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household.

There are specific ways we can collect personal data online, including, but limited to:

  • Using cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences, and other anonymous traffic data.
  • Using pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Services to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Services and response rates.
  • Through Google Analytics and/or Adobe Analytics, which use cookies and other, similar technologies to collect information about use of the Services and report website trends. From devices you use. This includes information collected through our Sites and automatically from devices you use to connect to our Sites. For more information about this, please see our “Cookies and similar technologies” section below. We may collect the physical location of your device and/or other location attributes (such as fenceID, speed, altitude, accuracy, and bearing) by, for example, using satellite, cell phone tower or WiFi signals. Geolocation services can be turned off in the Location Services area of your mobile device. You can stop all collection of such information by the Apps by uninstalling them.
From third parties sources. This includes personal data we collect from other third-party sources, including, but not limited to, vendors who collect data associated with or linkable to you (i.e. sensitive personal characteristics, commercial information, internet or other network activity, geolocation information, professional or employment information, education information and inferences) and websites that enable social sharing, social media sites, public sources, and websites from our service providers, other third parties, our affiliates, or other individuals and businesses.
From you in person. This includes personal data collected when you shop with us at our stores, including through your purchases, returns, exchanges, credit applications, and surveys, when you submit personal data to our point-of-sale devices, when you shop in view of our security cameras, when you connect to our in-store Wi-Fi or Bluetooth, or when you apply for a job.

3. Types of Personal Data We May Collect From You

Depending on how you interact with us or our Vendors, we may collect the following information:
  • Contact Information, such as your name, shipping and billing addresses, email address, telephone number, or other similar identifiers.
  • Biographic and Demographic Information, such as your date of birth, age, gender, and photos.
  • Financial and Payment Information, such as your credit card details, bank account number, financial information, and payment preferences.
  • Commercial Information, such as records of products purchased, considered, or other purchasing or consuming histories or tendencies.
  • Account Information, such as your online account user name and password, profile details you choose to provide, transcripts of customer service chats, and your feedback and reviews.
  • Internet Usage Information, such as your browsing history, search history, web-based location, IP address, and any other Internet usage information our Sites may automatically record when you visit.
  • Device Information, such as your browser or device model and settings, operating system, device ID, and unique identifiers.
  • Audio and Video Information, such as camera footage used for security and fraud/theft prevention in and around our stores, including in our parking lots.
  • Customer Support Information, such as the information you may provide when you interact in a live-session with our Customer Care personnel regarding a store purchase or online order. Our Customer Care personnel do not have access to and cannot see your payment information, including credit card number during these live sessions.
  • Inferences, such as inferences drawn from any of your personal data collected.
  • Other Personal Data you provide, such as the content provided either in your job application or in your communications with us, including interactions with us online, in-person, or on the phone.

4. How We Use, Sell, or Disclose Your Personal Data

We may use, sell, or disclose your personal data for the following reasons, depending on your relationship with us:

In addition to the above, we may disclose personal data collected from or about you with any of the following third parties and for any of the following purposes:
  • Vendors. We may provide personal data to Vendors who we engage to provide services to us, including payment processors, fraud detection partners, targeted advertising and marketing partners, shipping and logistics partners, identity unification firms and customer analytics or analysis firms.
  • Government, regulatory, or law enforcement agencies. We reserve the right to disclose your information to respond to valid information requests from government authorities and judicial requests, to investigate potential fraud, or where otherwise required by law. We may disclose your personal data where we believe the disclosure is necessary or appropriate to comply with regulatory or legal requirements, or to protect the safety, rights, or property of ourselves and others and to exercise, establish, or defend our legal rights.
  • In connection with a merger, acquisition, or business transfer. If we sell all or a part of our company, are part of a merger, consolidation, restructuring, sale of company stock, and/or sale of assets or other corporate change, your information may be transferred as part of that transaction.
  • At your direction. We may disclose your personal data at your direction or with your consent.
  • Collaborators. We may share personal data with collaborators with whom we jointly develop or promote our Sites, including sponsorships and co-branded opportunities and promotions.
  • The General Public. We may share personal data with the general public if you choose to share personal data when contributing content to our Sites through forums, blogs, social features, product reviews, or the like.
  • Aggregate Data. We may disclose your personal data in an aggregated or non-identifying form or otherwise in a form that cannot reasonably be used to identify you. We will not attempt to re-identify and/or link data we receive in an aggregate or de-identified state to any person, household, or device. Furthermore, Academy is not responsible for the privacy or data security practices of other organizations and has no control over and is not responsible for the accuracy of de-identified and/or anonymous data third parties pass to Academy.
Retention. We retain Personal Data only as long as we have a legitimate business purpose to keep it, which may include to:
  • complete the transaction for which the Personal Data was collected;
  • fulfill the terms of a written warranty or product recall;
  • continue our ongoing business relationship with you;
  • ensure the security and integrity of our Site and services; and
  • satisfy any legal or regulatory requirements.

To determine the appropriate retention period for individual categories of Personal Data, we collect, we consider the nature and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we process the information; whether we can fulfill those purposes through other means; and applicable legal or regulatory requirements.

5. Children's Privacy

You must be 18 years or older to use our Sites. Our Sites are for a general audience, are not targeted to children, and do not knowingly collect personal data from children under 13 years of age.

6. Links to Third-Party Websites

We may provide links to websites and other third-party content (e.g., credit card applications or social media platforms) that are not owned or operated by us. The websites and third-party content to which we link may have separate privacy notices or policies. We are not responsible for the privacy practices of these websites.
If you provide any personal data through a third-party site, your interaction and your personal data will be collected by and controlled by the privacy policy of that third-party site. We recommend that you familiarize yourself with the privacy policies and practices of any such third parties, which are not governed by this Privacy Policy.

7. Advertising and Opt-Out Disclosures

When you use our Sites, our third-party advertising partners, social media providers, and analytics providers may collect personal data about your online activity on our Sites and on third-party websites.
These providers may set web tracking tools (e.g., cookies and web beacons, as discussed further below) to collect information regarding your online activity. In addition, our advertising partners may use this information to deliver advertisements to you when you visit third-party websites within their networks. If you would like more information about this practice, and to know your choices with respect to it, please either visit the Digital Advertising Alliance's opt-out page (currently available at http://www.aboutads.info/choices/) or the Network Advertising Initiative's opt-out page (currently available at http://www.networkadvertising.org/choices/). You can adjust your advertising preferences on mobile devices through your device settings. On iOS devices, select the option to “Turn on Limit Ad Tracking.” On Android devices, select the option to “Opt Out of Interest-Based Ads.” Please note that you may continue to receive generic advertisements that are not based on your preferences. To opt out of all other types of targeted advertising please submit the form available here or, if allowed by the applicable state consumer data privacy law, the need to submit a request to opt-out of the processing or sale of personal data as an authorized agent, please submit the form available here.
Bridg. Bridg is a service provider we partner with to consolidate and enhance the customer data we have. Bridg services improve our targeted marketing campaigns, analytics, and data science efforts. Bridg collects data from a variety of sources, including surveys, purchasing behavior, publicly available sources, and other data partnerships. This data consists of demographics (such as age, occupation category, or whether a customer lives in a rural or urban community), commercial interests (including topics like sailing, dogs, or movies, for example), categories of past online activity (such as if the customer uses certain social media platforms and past purchases). 8. Information Security

We maintain administrative, technical, and physical safeguards to protect your personal information. We also follow the Payment Card Industry Data Security Standard (PCI DSS), when applicable, to protect your payment card transactions. However, no web site, mobile application, database, network, or computer is completely secure. You should also take reasonable steps to protect your personal information, including your passwords, against unauthorized disclosure or misuse. We investigate and respond to security incidents affecting your personal information and will notify you when required by applicable law.
We satisfy the Payment Card Industry ("PCI") security standards and requirements, which protect your payment card information by ensuring that it is processed, stored, and transmitted in a secure manner. We use a third-party processor for credit card and gift card transactions. Your credit card and gift card information is sent directly to that processor without being stored on our systems.

9. Cookies and Similar Technology

We and our Vendors and partners use various tools to collect data when you visit our sites and apps, including cookies, pixels, local Storage, consumer behavior analytics tools, and other similar technologies. Some of these technologies store data in your browser or on your device. Other technologies may use network-related or other information to recognize your device (e.g., IP address). Our Sites use these technologies, for example, when you first request a web page and data is then stored on your computer or other device so the website or mobile app can access personal data when you make subsequent requests for pages from that Site. These technologies may also be used to collect and store information about your usage of the Sites, such as pages you have visited, other content you viewed, and search history. We also use these technologies to send out reminders on abandoned shopping carts.
We and our Vendors and partners may also use these technologies to gather personal data about how you view and use our Sites and content and to connect your activity with other data we store about you. We and our Vendors and partners may collect your personally identifiable information about your online activities over time and across different websites (including third-party websites and competitor websites) when you use the Sites. The use of these technologies helps us serve you better by understanding what you are interested in, tracking trends, measuring the effectiveness of advertisements, saving your preferences, and storing information you may want to retrieve on a regular basis. We also allow specific, approved Vendors and partners to collect data from your browser or device for advertising and measurement purposes using their own similar tools.
Your web browser can be set to allow you to control these technologies, such as whether you will accept cookies, reject cookies, or to notify you each time a cookie is sent to your browser. If your browser is set to reject cookies, websites that are cookie-enabled will not recognize you when you return to the website, and some website functionality may be lost. The Help section of your browser may tell you how to prevent your browser from accepting these technologies, such as cookies. To find out more about cookies, visit www.aboutcookies.org. Depending on the make and model of your device, you may be able to use device settings to opt out of the use of certain device IDs for targeted advertising.
Some browsers permit the user to send a “Do Not Track” (“DNT”) preference to websites that the user visits indicating that the user does not wish to be tracked over time and across websites. Because there is not yet a common understanding of how to interpret DNT, we do not currently respond to the DNT signal on our websites. We do, however, respond to global privacy preferences when required by law.

You may opt out of targeting cookies here. Please note that if you do not accept cookies, you may experience some inconvenience in your use of the Services. For example, we may not be able to recognize your computer, and you may need to log in every time you visit. You also may not receive advertising or other offers from us that are relevant to your interests and needs.

10. Your Marketing Preferences via Mail, E-mail and Text

We may periodically send promotional materials or notifications related to our Sites. This includes email and text messages related to your abandoned online shopping carts. (A cart is considered abandoned within one hour of inactivity or lack of purchase.) If you no longer wish to receive promotional marketing materials from us you may opt out of receiving such materials. You may unsubscribe from receiving marketing or other commercial emails from us by following the instructions included in the email or by contacting Customer Care at 1-888-922-2336.
You may unsubscribe from text messages you previously consented to by:
  • Replying STOP to any text message you receive from us;
  • Texting STOP to 22369 - to unsubscribe from marketing, promotional, or cart reminder text messages; and
  • Texting STOP to 74840 - to unsubscribe from order confirmation, order update, and shipping confirmation text messages.
If you provide us with your postal address, you may receive periodic advertisements or promotional materials from us. If you do not wish to receive postal mailings from us or our Vendors or partners, please notify us by contacting Customer Care at 1-888-922-2336. Please provide us with your name and postal address and identify which lists you wish to be removed from when submitting your request for removal.
There are certain service notifications and other non-promotional emails that you may not opt out of, such as notifications of changes to our Sites or policies or information about your purchases or orders, such as shipping information, safety notices, and recall notices.

11. State Privacy Rights

Residents of certain states have additional rights with respect to their personal data, as described below. We honor those rights for residents of Colorado, Connecticut, Delaware, Iowa, Maryland, Montana, Minnesota, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia. In the event of a conflict between this section and the remainder of this Policy, this section shall take precedence for residents in these states.
A description of these rights and how residents of the above states may exercise these rights is below.

If you are a resident of another state, we will honor your data privacy rights to the extent the applicable law requires.

Right to Opt Out of the Sale or Processing of Personal Data for Targeted Advertising / Profiling: Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, and Virginia residents may direct us to cease processing their personal data for targeted advertising, selling their personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. Utah residents may submit a request to opt out of the processing of their personal data for purposes of targeted advertising or the sale of their personal data. Iowa residents may submit a request to opt out of the sale of their personal data.

Right to Data Portability: You may request a copy of the personal data you previously provided to us in a portable, and, to the extent technically feasible, readily usable format that will allow you to transmit the data to another business. Right to List of Third Parties: Residents of Maryland, Minnesota, or Oregon can request a list of the specific third parties to which we have disclosed consumer personal data. If you wish to request a list of specific third parties to which we have disclosed consumer personal data, you may do so by contacting Customer Care.
Right to Appeal: If you receive a denial of a personal data rights request, you have the right to request an appeal. If you wish to appeal a denied request, you may do so by calling us at 1-888-922-2336 or by contacting Customer Care. If you are a Texas resident and we deny your appeal, you may submit a complaint to the Texas Attorney General’s office online or by calling the Consumer Protection Hotline at 1-800-621-0508.

Depending on where you live, you may also submit a request to us through an authorized agent as described in more detail in the “Authorized Agents” section below.

Verifiable Consumer Requests:

You must provide sufficient information to allow us to reasonably verify you are the person about whom we collected personal data, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request.

When we receive your request: (a) we will acknowledge that we have received it; (b) we will try to match the information you provide in making the request with information we already maintain about you; (c) if required to verify your identity, we may ask you to provide additional information, including personal data, or to log into your existing account with us; and (d) we will consider various factors when determining how to verify your identity, such as the sensitivity and value of the data, the risk of harm, the likelihood of fraud, etc.

We will only use personal data we collect during the verification process for the purpose of verifying your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.

Global Privacy Control:

Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, and Texas residents may opt out of the sale or sharing of their personal data by broadcasting an Opt Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

Authorized Agents:

If you are a resident of Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon and Texas, you may use an authorized agent to exercise certain privacy rights on your behalf. If you choose to use an authorized agent to submit a request on your behalf, you must (a) provide signed permission to that authorized agent to submit requests on your behalf, and (b) verify your identity.

We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.

When We Will Respond:

We will try to respond to your request within 45 days. If we require additional time, we will inform you of the reason and any applicable extension period.

Non-Discrimination. We do not discriminate against anyone for exercising any privacy right listed in this Policy.

Information we collect. If you choose to participate in Email Sign Up or SMS Sign Up, Academy collects at a minimum, your email address or phone number.
If you choose to create or maintain a myAcademy account, Academy will collect, at a minimum, your name, first name, last name, email and phone number. Date of birth will be optional for certain myAcademy benefits.
If you choose to apply for an Academy credit card, Academy collects at a minimum, your name, last four digits of your social security number, date of birth, and annual income, mailing address, email address, and phone number.
How we use the information.We use your information to provide you special offers. We also use your information to improve and provide our products and services, as specified in Section 4. The information we collect may be sold or processed for targeted advertising.
The purposes for which your opted-in personal data may be used include:
  • Sending you marketing communications (which may include text messages or calls placed using autodialer technology), with your consent where required by applicable law;
  • Providing you with personalized advertisements, communications, offers, and/or other products or services that we believe may be relevant for you;
  • Sending you updates or other information related to the special offers or events you requested to receive; and
  • Analytics, statistical analysis, and other research.
Who we disclose your information with: The categories of third parties that may receive your personal data include:
  • Service providers: to facilitate the delivery of special offers to you and to provide you with the products and services that you have requested. We may also use service providers to assist us with managing, carrying out, and improving our advertising.
  • Partners: to provide benefits to you, such as the Academy credit card, through our partnership with our partners.
Personal data we collect from you through your interaction with the special offers will not be provided to data brokers.
Depending on where you live, you may opt-out of the sale and processing of your personal data for targeted advertising by using our, as described in more detail above.
Because your personal data is necessary for you to receive special offers, you understand that you will be unable to receive special offers if you submit a request for the deletion of personal data or opt out of the relevant program. Participation in the myAcademy rewards program is optional at the time of sign-up, and participants may withdraw from the program at any time by following the instructions outlined in Section 10 of the Terms and Conditions.

14. Automated License Plate Recognition

In addition to the personal data we collect from you as specified in Section 3, we may use Automated License Plate Recognition (ALPR) technology where not prohibited by law to collect information relating to vehicles present at or near our stores, including our parking lots. We collect, use, and share this information for fraud prevention, security, and assets protection. Access and use of the ALPR technology and information collected is restricted to Academy Team Members and/or contractors who are fulfilling one of the specified purposes, including assets protection, investigations, and legal reasons.

15. Updates to this Privacy Policy

We may update this Privacy Policy from time to time. To the extent permitted by law, any changes to this Privacy Policy will be posted to our Sites and will become effective upon posting. Any changes will be effective only on or after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.
